This "VMOS Cloud Website and Related Service Terms" (hereinafter referred to as "VMOS Cloud," "we," or "us") is jointly formulated by you (hereinafter referred to as "you" or "user") and VMOS Cloud. By accessing and using any services provided by VMOS Cloud, you acknowledge that you have read, understood, and accepted all terms and conditions stipulated in these service terms and in our Privacy Policy. If you do not agree, please refrain from accessing or using the services of VMOS Cloud.

1. Rights Statement

Any unauthorized actions, such as modifying, distributing, renting, translating, disassembling, decompiling, or reverse-engineering all or part of the program on this website, are considered infringements, and VMOS Cloud reserves the right to pursue legal action.

1.2 This website is protected by intellectual property laws, and any third party is prohibited from modifying, distributing, renting, translating, disassembling, decompiling, or reverse-engineering this software without official consent.

3.1 Website Usage Instructions:

This website is a cloud phone platform provided by VMOS Cloud, aimed at helping users create a healthy mobile smartphone ecosystem, offering virtual phone software applications and services. Before using the platform, users should carefully understand the following content:

3.1.1 This website supports remote control functions for mobile applications such as mobile games.

3.1.2 Use of this website requires registration of an account, and only registered users can use the platform. If a registered user violates the relevant agreements of the platform, VMOS Cloud has the right to suspend or terminate the user’s account usage rights.

3.1.3 When using this website to view received texts, images, files, etc., online, the user’s terminal device will generate corresponding data traffic fees, which are charged by the telecom operator.

3.1.4 This website is only applicable to the operating systems supported by the official website. If the user wishes to stop using the software for any reason after installation, they may use the deletion methods provided by the respective operating systems to remove the software.

3.2 Website Usage Rules:

Users should comply with the law and the terms of this agreement when using this website. Users may not engage in the following behaviors while using the website:

(9)Information that disrupts religious policy or promotes cults and feudal superstitions;

(10)Information that spreads rumors or falsehoods, disturbing economic and social order;

(11)Information that disseminates or promotes pornography, gambling, violence, murder, terrorism, or incites crime;

(12)Information that endangers network security, engages in activities harmful to national security, honor, or interests through the internet;

(13)Information that insults or defames others, infringing on their legal rights;

(14)Information that involves threats, intimidation, or violence against others or conducts unauthorized searches;

(15)Information that involves the privacy, personal information, or data of others;

(16)Information that contains obscene or offensive language that harms public order and good morals;

(17)Information that infringes on others' privacy, reputation, image, or intellectual property rights;

(18)Dissemination of unsolicited advertisements, spam, or excessive marketing information;

(19)Comments made in languages other than the commonly used languages of the website;

(20)Information irrelevant to the subject matter being commented on;

(21)Information without meaning, or deliberately using character combinations to evade technical reviews;

(22)Information that infringes upon the rights of minors or harms their physical and mental health;

(23)Unauthorized recording or photographing others, violating their rights;

(24)Content containing terror, violence, bloodshed, or high-risk dangerous activities, including but not limited to:

Any violent and/or self-harm activities;

Any performances involving dangerous tools or acts that endanger personal safety or property;

Encouraging or inducing others to engage in dangerous or illegal activities that could cause harm or death.

3.2.2 Users shall not engage in the following activities:

Deliberately bypassing or damaging the technical measures implemented by the software author or developer to protect copyright;

Using the software to mislead or deceive others;

Violating national regulations by deleting, modifying, adding, or interfering with the software system’s functionality, causing it to malfunction;

Disrupting the normal operation of the software system or deliberately spreading viruses or other destructive programs;

Any other actions that harm computer network security.

If any of the aforementioned behaviors are detected, the system will ban the user’s account, and VMOS Cloud reserves the right to handle the account and its assets. Banned accounts will not be unbanned, and assets in banned accounts will not be refunded. Users must bear the loss of account suspension due to the above reasons.

3.3 Account Responsibility

(1) The user is fully responsible for maintaining the confidentiality of their password and account, and for all activities that occur under the account. Any losses resulting from password leakage or forgotten usernames are the user's responsibility. If the user discovers any unauthorized use or theft of their account and password, or any other unauthorized or insecure behavior, the user should promptly notify VMOS Cloud platform in an effective manner and request the suspension of related services. The user understands that VMOS Cloud needs a reasonable amount of time to act on the user's request, and VMOS Cloud platform will not be liable for any losses incurred by the user due to actions taken before such suspension.

(2) The user understands and agrees that VMOS Cloud has the right to inquire about the real background and purpose of the user's use of the software services and may require the user to provide truthful, comprehensive, and accurate information. If VMOS Cloud has reasonable grounds to suspect that the information provided by the user is false, involves unauthorized offline transactions, fraudulent transactions, or violates VMOS Cloud's service rules, VMOS Cloud platform reserves the right to temporarily or permanently limit the use of some or all functions under the user's account.

3.4 Risks of Using Non-Designated Sites or Channels

For products accessed or used through non-designated sites or channels not authorized by VMOS Cloud, VMOS Cloud cannot guarantee whether those websites or software are infected with computer viruses, contain disguised trojans or hacker software. Using such websites or software may pose unpredictable risks. Users are advised not to download, install, access, or use them lightly. If such situations occur, VMOS Cloud assumes no responsibility for any losses or damages arising therefrom.

3.5 No Malicious Code

This website does not contain any malicious code intended to destroy users' mobile communication device data or obtain users' private information. It does not include any code to track or monitor users' behavior, either online or offline, nor does it collect users' personal information from other software or documents, or leak users' privacy.

3.6 Violation of Website Rules

If a user fails to comply with the website's usage rules, VMOS Cloud platform has the right to take appropriate measures, including but not limited to freezing, suspending, or terminating part or all of the services associated with the user's account and cloud phone, as well as deleting relevant information. In cases where the user's account is frozen, terminated, or deleted due to such actions, VMOS Cloud is not obligated to refund any fees. Any unused service fees will be retained by VMOS Cloud as liquidated damages, and the user will bear any losses to their account. If the user's actions cause VMOS Cloud platform to incur losses (including but not limited to legal fees and litigation costs), the user is also liable for compensation.

3.7 Compensation for VMOS Cloud’s Losses

If a user's breach of this agreement causes VMOS Cloud to suffer losses, including direct financial losses, reputational damage, and indirect losses such as legal fees and litigation costs, the user must compensate VMOS Cloud for all such losses.

3.8 Third-Party Claims

If a user's breach causes harm to any third party, the user must independently bear responsibility. Should VMOS Cloud be required to compensate the third party for any reason, the user must reimburse VMOS Cloud for the compensation immediately upon receiving notice.

4. Third-Party Software or Services

This website may use or include software or services provided by third parties (hereinafter referred to as "such services"). These services are provided in response to user needs and are designed to offer users more convenience. VMOS Cloud does not produce content. When users use such services, they should separately enter into service agreements with the third party, pay the corresponding fees, and assume any potential risks. If users continue to use this software or service, they are considered to have agreed to the following:

4.1 VMOS Cloud has no authority to grant users any rights to use third-party software or services under this agreement, nor to provide any form of guarantee or corresponding customer service support for such services. If users need to inquire about related information, they should directly contact the third party. If any disputes or losses arise from the use of such services, users can negotiate directly with the third party for resolution, and VMOS Cloud assumes no responsibility or liability for compensation.

4.2 The current services on this website and the services currently included on this website are not guaranteed to be permanently available by VMOS Cloud. VMOS Cloud does not guarantee that users will be able to use these services or the website's content permanently without change. It is also not guaranteed that similar or different websites, software, or services will not be used in the future. Once the content of the website changes or is upgraded to include the aforementioned services, this agreement will still apply.

4.3 If a third party confirms that a user has violated the agreement with them regarding the use of such services and ceases to provide such services to the user while requesting VMOS Cloud's assistance, the user understands and agrees that VMOS Cloud will take technical measures to suspend or terminate the user's continued use of the third-party software.

We guarantee service quality and make every effort to meet your expectations.

5. Eligibility and Acceptable Use

To use the services of VMOS Cloud, you must meet certain eligibility criteria. You may browse the VMOS Cloud website without registering an account. However, to register an account, you must be at least 18 years old or of legal contracting age in your region. You are responsible for your account and all activities that occur under it.
